CIPPIC granted leave to intervene in Supreme Court case

The Supreme Court of Canada has granted CIPPIC leave to intervene in a precedent-setting case involving electronic commerce and pre-dispute binding arbitration clauses in consumer contracts. The case, Dell Computer Corp. v. Union des Consommateurs and Olivier Dumoulin, involves Dell's attempt to block a class action in Quebec on the basis of a mandatory arbitration clause in its online terms of service. Host liability for online defamation at stake in lawsuits

Two Canadian website hosters are seeking support for their defence against defamation lawsuits. Jon Newton, operator of p2pnet.net, and Michael Pilling, operator of openpolitics.ca, are both being sued for allegedly defamatory comments made by others on their websites. Unlike the U.S.A., Canada does not have statutory limits on the liability of ISPs and web hosters for comments made by others via their sites. CIPPIC files privacy complaint about SWIFT

Together with Privacy International, CIPPIC has filed a formal complaint with the Privacy Commissioner of Canada against the "Big Six" Canadian banks, regarding allegedly unlawful disclosures of personal banking information to the U.S. government by SWIFT, a Belgium-based clearinghouse for international bank transfers. Under federal data protection law, banks are responsible for personal information that they outsource for processing purposes.

OPCC seeks comment on PIPEDA Review

The Office of the Privacy Commissioner of Canada (OPCC) is seeking public comment on the effectiveness of Canada's national private sector data protection law. The Personal Information Protection and Electronics Document Act ("PIPEDA") came into force in 2001 and is scheduled for Parliamentary review this fall. Librarians Condemn

Delegates to the Annual General Meeting of the Canadian Library Association unanimously passed a resolution condemning Access Copyright's misguided "Captain Copyright" advocacy website. Resolution 4 condemns the Access Copyright initiative as posing "a threat to our shared information commons by providing biased copyright information to the Canadian public, particularly children and schoolteachers." The CLA will be writing to Access Copyright to condemn the initiative, and has asked its Copyright Working Group to "monitor and critique the views expressed by Access Copyright, in order to provide reliable copyright information to Canadian libraries and the broader public." - CLA Resoultion
