CIPPIC Offers View on Standing of Group of 99

CIPPIC, on behalf of its clients, the Canadian Association of University Teachers (CAUT) and the Canadian Federation of Students (CFS) has submitted its views to the Copyright Board on its "standing" ruling in the Access Copyright Post-Secondary Tariff Proceeding. CAUT/CFS take the following positions:
- CAUT and CFS accept the Board's grant of "intervenor status with full participatory rights";
- Notwithstanding the foregoing, CAUT and CFS offer the Board its interpretation of the language of the Copyright Act bestowing standing as objectors to a tariff;
- Interrogatories are the Board's to order, not Access Copyright's to demand; and
- Access Copyright's application for an interim decision should be rejected, and in any event, should be subject to a proceeding.
