CIPPIC defends consumer rights in Supreme Court of Canada

CIPPIC appeared before the Supreme Court of Canada today in the case of Dell v. Union des Consommateurs. Mistrale Goudreau, counsel for CIPPIC, argued that pre-dispute mandatory arbitration clauses in consumer contracts cannot bar class actions under Quebec law. CIPPIC also argued that a mere hyperlink to the terms of sale on a website is insufficient notice for the purpose of contracting online with consumers. The court is now deliberating.
